Quinn Allman, former guitarist for The Used, is suing the band over proceeds from past touring, album and merchandise sales. The musician, who claims he was fired from the band, is also seeking damages for late and irregular royalty payments.

Allman is a founding member of The Used, dedicating 14 years of his life to the band starting in 2001. In February 2015, it was revealed Allman had chosen to take a year-long hiatus from The Used, with his bandmates declaring, “We wish him the best in his endeavors and look forward to the day he rejoins us on the road.” An official reason for Allman’s break wasn’t included, but according to a new article in The Salt Lake Tribune, the guitarist made his decision following the death of his father-in-law and an assault on his mother.

In November 2015, The Used announced Allman’s departure, painting it as “a result of mutual understanding.” However, the guitarist says he was kicked out of The Used. According to Quinn Allman’s lawsuit, vocalist Bert McCracken informed Allman he wasn’t welcome to attend an April 2015 Used show in Salt Lake City, Utah, where Allman lives. A month later, McCracken reportedly texted Allman, “We don’t want things to go back to the way they were before.”

Allman says he received a termination agreement in September 2015, asking him to sign away his membership in the corporate entities the band operates through The Used, LLC, and Burning Touring Inc. The guitarist refused to sign the paperwork, as it didn’t include severance pay or any control of his royalty payments.

The lawsuit alleges The Used continue to profit “primarily from Allman’s work and contribution” without offering adequate compensation in return. Allman’s lawyer declined to share the amount he is seeking with the lawsuit, but revealed it would be “no event less than $250,000.” One entity which Allman claims he hasn’t received authorship royalties from is Live & Acoustic at the Palace, a live Used album filled with Allman-era songs.

A suit to dissolve The Used, LLC has also been filed by Allman, with the guitarist seeking additional damages caused by his exit from the band. A court date has not yet been scheduled and representatives for The Used have not, as of this posting, offered comment to the press.
